A Noteworthy Appellate Case
Mr. Foster’s enthusiasm for appeals work and his thorough preparation have paid off for his clients. In Security Life Insurance Co. v. Meyling [146 F.3d 1184 (9th Cir. 1998)], he spearheaded a major ERISA health-care case which involved issues of first impression in federal litigation. As lead attorney, Robert Foster formed an action team involving younger attorneys, experienced attorneys and paralegals and directed analysis of all issues and research.
The client was accused of misrepresenting information on his insurance policy, and was denied coverage for $750,000 in medical bills. Mr. Foster argued that the policy contained a remedy for misrepresentation in the form of surcharged premiums. Though the position was rejected by the United States District Court judge, Mr. Foster prevailed on appeal in the Ninth Circuit, winning full recovery for the client, plus payment of costs and attorneys' fees.
